Mobile Wallet Terms and Conditions Agreement
Thank you for using your Martha’s Vineyard Bank MasterCard® debit card (“Card”) within Apple Pay, Samsung Pay, Google Pay, or other similar payment applications (“Mobile Wallet”). Mobile Wallet is a way to carry your credit and debit card information in a secure form on your mobile device. It allows you to use your mobile device to make purchases in place of presenting or using your physical Card with near field communication enabled merchants who accept the Mobile Wallet as a form of payment. These Terms and Conditions govern your use of any Mobile Wallet or related features or services available on payment-supported devices for the purposes of purchasing goods and services with a Mobile Device. These Terms and Conditions are a legal agreement between you and Martha’s Vineyard Bank (“MV Bank”). They apply to you and anyone you authorize to use your Mobile Payment Services. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE CREATING, ACTIVATING OR USING YOUR MOBILE WALLET, BECAUSE BY DOING SO, YOU ACCEPT AND AGREE TO BE BOUND BY AND ABIDE BY THESE TERMS AND CONDITIONS. IF YOU DO NOT WANT TO AGREE TO THESE TERMS AND CONDITIONS, YOU MAY CHOOSE NOT TO CREATE, ACTIVATE OR USE A MOBILE WALLET.
MV Bank will determine, at its sole discretion, which Cards may be eligible for use through the Mobile Wallet. If your Card or underlying account is not in good standing it will not be eligible to enroll in a Mobile Wallet. MV Bank reserves the right to decline enrollment of a Card to a Mobile Wallet without the need to provide a reason. Your use of a Mobile Wallet will also be subject to the applicable agreements or terms of use with the provider of the Mobile Wallet and other third parties (such as your wireless carrier and other merchants, websites and services integrated into a Mobile Wallet).
Your Card Terms Do Not Change. The terms and account agreement that govern your Martha’s Vineyard Bank Card do not change when you add your Card to the Mobile Wallet. The Mobile Wallet simply provides another way for you to make purchases with your Card. MV Bank does not charge additional fees for adding your Card to Mobile Wallet or using it through the Mobile Wallet. The Mobile Wallet and other third parties such as wireless companies or data service providers may charge you fees. Any limits MV Bank places on the frequency or dollar amount of your Card transactions will also apply to Mobile Wallet transactions. Adding or Removing Your Card. To add a Card to a Mobile Wallet, you must follow the procedures adopted by the wallet provider and any further procedures MV Bank institutes. Adding a Card to the Mobile Wallet allows you to use the Card to complete transactions where the Mobile Wallet is accepted. The Mobile Wallet may not be accepted by all merchants where your Card is accepted. You may remove a Card from the Mobile Wallet by following the applicable Mobile Wallet provider’s procedures for removal.
MV Bank is Not Responsible for the Mobile Wallet. MV Bank has no control over mobile device requirements for the Mobile Wallet. MV Bank is not the provider of the Mobile Wallet and MV Bank is not responsible for providing the Mobile Wallet service to you. MV Bank is responsible only for supplying information securely to the Mobile Wallet. MV Bank is not responsible for any transaction failure in the Mobile Wallet, for the performance or non-performance of the Mobile Wallet, nor for any third-party agreements or associated relationships that may impact your use of the Mobile Wallet. You should contact the Mobile Wallet provider with any Mobile Wallet issues or questions.
You agree to keep your Martha’s Vineyard Bank Card Secure and Notify MV Bank of Errors or Fraud. You agree to protect and keep your user ID, passwords and all other information used to make purchases with your Card using the Mobile Wallet secure. Your Martha’s Vineyard Bank Electronic Funds Transfer (EFT) Agreement requires you to promptly notify MV Bank if your mobile device or Card is lost or stolen or if you suspect fraudulent transactions. Contact MV Bank by calling (508) 627-4266 during published business hours or (800) 472-3272 outside of business hours.
Electronic Communications. By registering and using your Card in connection with the Mobile Wallet you consent to receive from MV Bank: (i) electronic notifications to the email address on record with MV Bank; and (ii) automatically dialed calls or text messages to the mobile phone numbers on record with MV Bank. You agree to update your contact information with MV Bank promptly if it changes. If you prefer paper notices, you have the right to withdraw your consent by contacting MV Bank. If you withdraw your consent, MV Bank may suspend or cancel your ability to use your Card in connection with the Mobile Wallet.
Privacy Policy. MV Bank will use, share, and protect your personal information in accordance with our Privacy Policy applicable to your Card account. You acknowledge that: (i) the Mobile Wallet and its sub-contractors, agents and affiliates, or other third parties supporting the Mobile Wallet, and (ii) the applicable payment network branded on your Card, as well as such network’s sub-contractors, agents, and affiliates, will have access to certain details of your transactions made with merchants via use of your Card through the Mobile Wallet. You acknowledge that the use and disclosure of any personal information provided by you directly to Mobile Wallet, the applicable payment network branded on your Card, or other third parties supporting the Mobile Wallet, will be governed by such party’s privacy policy.
Security of the Mobile Wallet. You understand that the security of information provided to or stored by third parties in connection with the Mobile Wallet is outside of MV Bank’s control. MV Bank is not responsible for any security breach affecting information collected, stored, or sent in connection with the Mobile Wallet.
Merchant Disclaimers. Merchants may offer certain discounts, rebates, or other benefits ("Offers") through the Mobile Wallet. MV Bank will not be liable for any loss or damage as a result of any interaction between you and a merchant with respect to such Offers. Subject to these Terms and Conditions, applicable law and your Card account documents, all matters, including delivery of goods and services, returns, and warranties, are solely between you and the applicable merchants. You acknowledge that MV Bank does not endorse or warrant the merchants that are accessible through the Mobile Wallet, nor endorse or warrant the Offers that they provide.
Changes to this Agreement. MV Bank may change or modify these Terms and Conditions at any time without notice to you, unless required by law, by updating these Terms and Conditions in the Mobile Wallet. You are bound by such revisions and should therefore review the current Terms and Conditions from time to time. Your use of the Card after a change or modification to the Terms and Conditions reflects your acceptance.
Governing Agreements. The applicable MV Bank Deposit Account Agreement and Electronic Fund Transfer Disclosure, provided at account opening and Card issuance and as amended from time to time, govern your Card and are incorporated in these Terms and Conditions by reference. Please review those agreements, as applicable, for important information on your rights and responsibilities when making transactions through a Mobile Wallet.
